The Commission may discuss, consider and/or make recommendations to Council to approve or disapprove the following items:
a. A petition from Kimberley Ann Ogden and Arthur J. Silva, represented by Chuck Christian to rezone the following properties from Residential Agricultural to Light Industrial (L-1):
i. a 3.319 acre tract of land out of a 10.00 acre tract of land according to the deed recorded in Volume 316, Page 298, Deed Records of Comal County, Texas; said 10.00 acre tract being out of a 111.25 acre tract conveyed by deed to H.L. McLaughlin, et al and being a part of the George H. Dolson Survey No. 96, recorded in Volume 96, Page 415, Deed Records of said County and known as 19195 Nacogdoches Loop, Garden Ridge, Texas
ii. a 2.67 acre tract of land situated in Comal County, Texas out of the G.M. Dolson Survey No 96, Abstract 120, consisting of that 2.52 acre tract conveyed to Leprechaun Ranch, Inc. recorded in Document No. 200206001566 of the Deed Records of Comal County, and known as 19197 Nacogdoches Loop, Garden Ridge, Texas
b. A petition from Kimberley Ann Ogden and Arthur J. Silva, represented by VALRO Enterprises, Inc., management company for Key Insulation, Builders Energy Rate and IBS Advisors for the following variances to the properties at 19195 and 19197 Nacogdoches Loop, Garden Ridge, Texas.
i. Paragraph 7.1.4.3. Side Yard: Petitioner is requesting that the requirement of a paved alley ROW fifteen feet down each property line be waived. Petitioner desires is to maintain the property in its present “natural” state and preserve the hand stacked rock wall that exists on the rear and side property lines.
ii. Paragraph 7.1.4.4. Rear Yard: Petitioner is requesting that the requirement of a paved rear alley ROW at the rear of the property be waived. Buildings currently on the site which will be used as offices occupy the rear of the property and a hand stacked rock wall exists on the rear and side property lines that the Petitioner wants to preserve.
iii. Paragraph 7.1.7. Construction Standards: Petitioner is requesting variances to the 90% masonry requirement. Petitioner is proposing that the construction of a new warehouse is be masonry on the frontage/façade that faces the road only, and that the remainder of the building may be lumber or metal which match the remainder of the buildings. The Petitioner is also requesting that existing buildings be allowed to maintain their present masonry percentage until such time as the buildings require additions which constitute 30% or more of the existing structure.
iv. Paragraph 7.1.8. Exterior Lighting: Petitioner is requesting that exterior lighting shall be installed as flood lights that are shielded as per typical commercial lighting.

c. A petition from Kimberley Ann Ogden and Arthur J. Silva, represented by VALRO Enterprises, Inc., management company for Key Insulation, Builders Energy Rate and IBS Advisors for a Master Plan of the combined properties at 19195 Nacogdoches Loop and 19197 Nacogdoches Loop for use by Key Insulation, Builders Energy Rater and IBS Advisors to construct and operate a business complex composed of offices, classrooms and a warehouse.
d. An amendment to Ordinance 13-092008, paragraph 5.1.3 to include an explanation of what constitutes a parking pad for the purposes of that Ordinance.
e. Further changes to Ordinance 13, Section 5, Paragraph 5.1.3 concerning parking on the grass and right of ways. (Discussion only )
f. Further changes to Ordinance 13, Section 5, Paragraph 5.1.8.1 regarding mailboxes. (Discussion only)
7. Administrative Items
The Commission may discuss, consider and/or take possible action on the following items:
a. Election of chair, vice-chair and secretary for the Garden Ridge Planning and Zoning Commission for the period October 1, 2008 to September 30, 2009.
b. Approve or disapprove the voting session minutes of August 21, 2008.
c. Approve or disapprove the work session minutes of September 9, 2008.
d. Approve or disapprove the work session minutes of October 14, 2008.
e. Set date, time and location for next meeting.
